font-size: 12pt; font-style: inherit; font-weight: inherit;\">El 3 de diciembre de 2025, el Consejo de Representantes de la Comisi\u00f3n Nacional de los Salarios M\u00ednimos (CONASAMI) determin\u00f3 que, a partir del 1 de enero de 2026, el salario m\u00ednimo general tendr\u00e1 un incremento significativo, pasando de $278.80 a $315.04 pesos diarios, mientras que en la Zona Libre de la Frontera Norte aumentar\u00e1 de $419.88 a $440.87 pesos diarios.\u00a0<\/span><\/p><p><span style=\"font-family: Arial, sans-serif; font-size: 12pt; font-style: inherit; font-weight: inherit;\">Este ajuste no solo impacta de manera directa en la n\u00f3mina de las empresas, sino\u00a0<\/span><span style=\"font-family: Arial, sans-serif; font-size: 12pt; font-style: inherit; font-weight: inherit;\">tambi\u00e9n en m\u00faltiples conceptos vinculados al salario, tales como cuotas\u00a0<\/span><span style=\"font-family: Arial, sans-serif; font-size: 12pt; font-style: inherit; font-weight: inherit;\">obrero-patronales, aportaciones al IMSS e INFONAVIT, c\u00e1lculo de prestaciones\u00a0<\/span><span style=\"font-family: Arial, sans-serif; font-size: 12pt; font-style: inherit; font-weight: inherit;\">laborales, finiquitos, liquidaciones y tabuladores salariales internos.<\/span><\/p><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Asimismo, obliga a las empresas a revisar que ning\u00fan trabajador perciba un ingreso inferior al nuevo m\u00ednimo legal, independientemente de la forma de contrataci\u00f3n.<\/span><\/p><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Para los empleadores, el incremento al salario m\u00ednimo implica la necesidad de revisar estructuras salariales completas, ya que en muchos casos se generan distorsiones internas cuando los salarios base se acercan o igualan a niveles jer\u00e1rquicos superiores. Una actualizaci\u00f3n oportuna permite evitar conflictos laborales, reclamaciones individuales o colectivas, as\u00ed como observaciones en inspecciones de la autoridad laboral.<\/span><\/p><h2><span style=\"font-family: Arial, sans-serif;\">Reducci\u00f3n de la jornada laboral.<\/span><\/h2><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">El 3 de diciembre de 2025, fueron presentadas ante la C\u00e1mara de Senadores dos iniciativas con proyecto de decreto: una propone reformar y adicionar disposiciones del art\u00edculo 123, apartado A, de la Constituci\u00f3n Pol\u00edtica, y la segunda plantea reformar y adicionar disposiciones de la Ley Federal del Trabajo.<\/span><\/p><h3><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Reforma Constitucional en materia de jornada laboral.<\/span><\/h3><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">La iniciativa de reforma constitucional propone establecer, como regla general, una jornada laboral m\u00e1xima de 40 horas semanales, garantizando que por cada seis d\u00edas de trabajo las personas trabajadoras cuenten con al menos un d\u00eda de descanso con goce de salario \u00edntegro. Este cambio busca redefinir la organizaci\u00f3n del tiempo de trabajo en M\u00e9xico de manera progresiva.<\/span><\/p><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">En materia de tiempo extraordinario, la propuesta eleva a rango constitucional los l\u00edmites y formas de pago. Se establece que el trabajo extra podr\u00e1 realizarse hasta por 12 horas semanales, distribuidas en un m\u00e1ximo de 4 horas diarias y hasta en 4 d\u00edas por semana, debiendo pagarse con un 100% adicional al salario ordinario. Cuando se exceda dicho l\u00edmite, el tiempo adicional deber\u00e1 pagarse con un 200% m\u00e1s, y se incorpora expresamente la prohibici\u00f3n de que menores de 18 a\u00f1os laboren tiempo extraordinario.<\/span><\/p><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Para facilitar la transici\u00f3n, la reforma contempla una reducci\u00f3n gradual de la jornada laboral entre 2026 y 2030, iniciando con 48 horas semanales en 2026 y disminuyendo dos horas por a\u00f1o hasta llegar a 40 horas en 2030. Una vez publicada la reforma, el Congreso de la Uni\u00f3n contar\u00e1 con 90 d\u00edas para adecuar la legislaci\u00f3n secundaria, principalmente la Ley Federal del Trabajo.<\/span><\/p><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">La entrada en vigor de esta reforma constitucional requiere la aprobaci\u00f3n de las dos terceras partes del Congreso de la Uni\u00f3n, la ratificaci\u00f3n de la mayor\u00eda de las legislaturas estatales y su publicaci\u00f3n en el Diario Oficial de la Federaci\u00f3n.<\/span><\/p><h3><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Reforma a la Ley Federal del Trabajo.<\/span><\/h3><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">De manera paralela, la iniciativa de reforma a la Ley Federal del Trabajo busca armonizar la legislaci\u00f3n secundaria con el nuevo modelo de jornada laboral. Entre los cambios m\u00e1s relevantes, se precisa el concepto de persona empleadora, se redefine la jornada laboral como el tiempo en que la persona trabajadora presta servicios subordinados y se fija una duraci\u00f3n m\u00e1xima de 40 horas semanales, manteni\u00e9ndose la jornada diaria de hasta ocho horas sin modificar los esquemas diurno, nocturno y mixto.<\/span><\/p><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">En cuanto al trabajo extraordinario, la ley establece que este podr\u00e1 realizarse \u00fanicamente en circunstancias excepcionales y deber\u00e1 pagarse con un 100% adicional, con un l\u00edmite m\u00e1ximo de 12 horas semanales, distribuidas en condiciones espec\u00edficas. Cuando se exceda ese l\u00edmite, el tiempo adicional deber\u00e1 pagarse con un 200% m\u00e1s, sin que la suma de la jornada ordinaria y extraordinaria pueda exceder de 12 horas diarias.<\/span><\/p><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Un cambio relevante para las empresas es la incorporaci\u00f3n de la obligaci\u00f3n patronal de llevar un registro electr\u00f3nico de la jornada laboral, conservar dicha informaci\u00f3n y ponerla a disposici\u00f3n de la autoridad cuando sea requerida. Esta medida refuerza las facultades de verificaci\u00f3n y control en materia laboral.<\/span><\/p><p><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">La reforma a la Ley Federal del Trabajo prev\u00e9 su entrada en vigor el 1 de mayo de 2026, aunque algunos aspectos, como la duraci\u00f3n m\u00e1xima del trabajo extraordinario, se implementar\u00e1n de forma gradual hasta 2030. La obligaci\u00f3n del registro electr\u00f3nico de jornada entrar\u00e1 en vigor a partir del 1 de enero de 2027. Para su validez, la iniciativa requiere la aprobaci\u00f3n de mayor\u00eda simple en el Congreso, su promulgaci\u00f3n por el Ejecutivo Federal y su publicaci\u00f3n en el Diario Oficial de la Federaci\u00f3n.<\/span><\/p><h2><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Recomendaciones y actuaciones administrativas para una transici\u00f3n legal y ordenada.<\/span><\/h2><p class=\"MsoNormal\"><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Ante el aumento al salario m\u00ednimo y la eventual reducci\u00f3n de la jornada laboral, resulta indispensable que las empresas adopten una estrategia preventiva, orientada no solo al cumplimiento formal, sino a la correcta administraci\u00f3n de sus relaciones laborales.<\/span><\/p><p class=\"MsoNormal\"><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Es recomendable realizar una revisi\u00f3n integral de contratos individuales y colectivos de trabajo, a fin de verificar que las condiciones pactadas se encuentren alineadas con las nuevas disposiciones salariales y de jornada, as\u00ed como actualizar cl\u00e1usulas relacionadas con horarios, tiempo extraordinario, descansos y mecanismos de control de asistencia. Una redacci\u00f3n adecuada reduce significativamente riesgos de interpretaci\u00f3n y conflictos futuros.<\/span><\/p><p class=\"MsoNormal\"><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Asimismo, las empresas deben actualizar sus pol\u00edticas internas, tabuladores salariales, reglamentos de trabajo y sistemas de control de jornada, especialmente ante la futura obligaci\u00f3n de llevar registros electr\u00f3nicos de tiempo laboral, los cuales ser\u00e1n un elemento clave en inspecciones y procedimientos ante la autoridad.<\/span><\/p><p class=\"MsoNormal\"><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Desde una perspectiva administrativa y de cumplimiento, resulta aconsejable llevar a cabo auditor\u00edas laborales internas, que permitan identificar \u00e1reas de riesgo, inconsistencias en la n\u00f3mina, pr\u00e1cticas operativas no alineadas con la ley y oportunidades de mejora en la gesti\u00f3n del capital humano. Estas auditor\u00edas facilitan la toma de decisiones informadas y minimizan contingencias legales y econ\u00f3micas.<\/span><\/p><p class=\"MsoNormal\"><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Finalmente, una correcta asesor\u00eda laboral y corporativa permite a las empresas gestionar de manera adecuada su relaci\u00f3n con autoridades como la Secretar\u00eda del Trabajo y Previsi\u00f3n Social, atender inspecciones, requerimientos o procedimientos administrativos, y acompa\u00f1ar a la organizaci\u00f3n en la implementaci\u00f3n de cambios normativos sin afectar su operaci\u00f3n.<\/span><\/p><p class=\"MsoNormal\"><span lang=\"es-419\" style=\"font-size: 12.0pt; line-height: 107%; font-family: 'Arial',sans-serif;\">Anticiparse a estos ajustes no solo garantiza el cumplimiento legal, sino que fortalece la estabilidad interna de la empresa y su capacidad de adaptaci\u00f3n ante un entorno laboral en constante transformaci\u00f3n.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9ba4630 elementor-widget
